Terms of Service
1. These terms
These Terms of Service (“Terms”) are an agreement between you and [JELLY ENTITY — Q14] (“Jelly”, “we”, “us”). They govern your use of the Jelly iPhone app, the Jelly website at onjelly.com, and everything we offer through them (together, the “Services”).
By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1.1 Words we use
- Services — the Jelly app and the Jelly website, together with the features in them.
- Item — a garment or accessory listed on Jelly.
- Lender — a member who lists an Item for rent or for sale.
- Renter — a member who books an Item for a rental period.
- Buyer — a member who purchases an Item outright.
- Transaction — a rental or a purchase between two members.
- Content — anything you upload or post: photos, listing text, reviews, messages, profile details.
- Credits — Jelly account credit. Spendable in the app, never paid out as cash.
1.2 Where Jelly operates
Jelly currently operates in New York City only. Delivery is by courier or by free handoff between members. We do not ship items, and we do not operate outside the New York City courier area.
2. Eligibility
You must be 18 or older and reside in the United States or its territories to use the Services.
You must not supply the personal information of anyone under 13 to Jelly — for delivery, for an account, or for any other reason.
We may refuse, suspend or close an account at any time under section 29.
3. Your account
- Give us accurate information and keep it current.
- One account per person. Do not create a second account, and do not create an account for someone else.
- You are responsible for what happens under your account. Keep your password to yourself and tell us at help@onjelly.com if you think someone else has it.
- Your public profile shows your first name and handle — never your full name, address, email or phone number. See section 8.
4. What Jelly is, and what it is not
Jelly is a marketplace. Members list their own clothes; other members rent or buy them. Jelly provides the app, the payment rails, the courier logistics and the support desk.
Jelly is not a party to any Transaction between members. We do not own, manufacture, store, clean, inspect or authenticate the Items listed on Jelly. The rental or sale agreement is between the two members. Section 24 sets this out in full.
5. Booking, prices and payment
5.1 Instant book
Rentals on Jelly are instant. When you book an Item that is available on your dates, the booking is confirmed straight away. There is no offer to send and no wait to be chosen.
5.2 What you are shown before you pay
Every line of the total is named and shown to you before any charge: the rental (day rate × days), the courier fee, and any credits applied. There are no unnamed charges.
5.3 When you are charged
You are charged when you book, before the Item moves.
5.4 Currency and taxes
All amounts are in US dollars.

- Jelly’s commission on a rental is 20% of the rental price. The courier fee is not part of the rental price and is not commissioned.
- A lender’s funds become available 12 hours after the Item is marked delivered to the renter. The window exists so a renter can report a problem before money moves.
- Available funds can be spent in the app or sent to a bank account. Bank transfers are handled by our payments processor and typically take 2–3 business days.
- Late fees carry the same commission as the rental.
- Where a rental is refunded, there is no payout on it.
- Payouts run through Stripe Connect. You will need to complete Stripe’s onboarding before Jelly can pay you.
[Q31 OPEN] A $3 minimum commission. Pickle charges “20% of rental price (minimum $3)”, a flat $3 under $15. Not yet decided for Jelly, so no minimum is stated here.[LAWYER] Tax reporting — 1099-K thresholds and W-9 collection.7. Delivery
- Courier. $10 per leg, paid by the renter. A rental booked for courier delivery is $10 out and $10 back — $20 in total, shown as its own line before you pay. A purchase has one leg, so $10.
- Handoff. Free. The two members agree a time and place.
- Jelly books the courier and is the sender and recipient of record on every leg.
- Delivery fees are not refunded on a fit refund (section 10).
[LAWYER / OPEN] Declared-value limits on couriered items. Pickle publishes a $2,000 ceiling for courier insurance and a $10,000 ship ban; Jelly’s courier contracts are not yet signed, so no limit is stated here.8. Anonymity between members
Renters and lenders do not see each other’s identities.
- Other members see your first name, handle, profile photo, bio, closet, and reviews.
- Other members never see your full name, email address, phone number or street address.
- Jelly passes addresses to the courier because a courier has to drive to them. Members do not receive each other’s addresses at any point.
9. Cancellation
9.1 Renter cancels a rental

Delivery fees are not refunded in the 50% tier.
[LAWYER / CONFIRM] Pickle’s published tier says “50%” without stating whether delivery is included. Jelly’s system refunds 50% of the rental and retains the courier fee — described here as what the system does, not as a copied clause.9.2 Lender cancels a rental
- Within 2 hours of the booking: free.
- After that: a $20 fee, paid to the renter as credits.
- No fee where the cancellation is caused by a previous renter returning late.
9.3 Both sides agree
Members who agree to cancel can contact help@onjelly.com and we will close the booking out.
10. Fit refunds
A fit refund is a refund on an Item that arrived exactly as described but did not fit.
- The lender sets the fit policy, per listing. The options are 100%, 50%, none, or case by case on request. The choice is shown on the listing before you book.
- The default is “no fit refunds.”
- Jelly funds no fit refunds. A fit refund is always the lender’s, from their side of the Transaction. Where a listing offers one, the lender does not receive a payout on that rental.
- Fit refunds are paid in credits, never back to your card.
- To claim one you must report within 12 hours of delivery, with photos, and return the Item the same day.
- Delivery fees are never refunded on a fit refund.
- Change of mind is not a fit refund, and a report made more than 12 hours after delivery is outside the window.
11. Not as described
If an Item arrives materially different from its listing, report it with photos within 12 hours of delivery and return it the same day. A confirmed not-as-described report is refunded in full, including delivery both ways.
12. Returning an Item
The renter returns the Item by the end date, by the delivery method booked.
12.1 Late fees
- Late fees are toggled by the lender, per listing. They are not universal. Whether they apply is shown on the listing.
- The daily fee is the rental price divided by 7 — or by the number of rental days, whichever is greater. A $50 three-day rental is $7.14 a day; a $50 ten-day rental is $5.00 a day.
- Fees start the day after the end date and accrue for a maximum of 7 days.
12.2 After 7 days
If an Item is more than 7 days late, it may be treated as not returned. The renter may be charged its replacement value, based on current resale market data — not the original retail price.
12.3 Extensions
[Q27 OPEN] Rental extensions. Pickle’s extensions are owner-approved, prorated, and suspend late fees for the extended window. Jelly’s instant-book model may or may not carry through to extensions; the mechanic is not decided, so nothing is stated here.13. Damage and loss
- Normal wear is expected and is not chargeable. Wrinkles, deodorant marks, small washable stains, pilling and minor scuffs are normal wear.
- Damage beyond normal wear is the renter’s responsibility: the cost of repair, or, if the Item cannot be repaired, its replacement value based on current resale market data.
- An Item that is not returned is charged at replacement value on the same basis.
- A lender must report damage or loss within 48 hours of the return, with condition-report photos.
- A lender must send Items out clean and as described. Items sent out dirty, altered, or not as described are not covered.
14. Sub-renting and transfer
You may not sub-rent, lend on, or otherwise transfer an Item you have rented to anyone else. If you do, you remain fully responsible for the Item regardless of who has it.
15. Keep it on Jelly
Payments for Transactions must go through Jelly. If you arrange payment off-platform, Jelly Protection does not apply, our support desk cannot resolve the dispute, and your account may be closed.
16. Jelly Protection
Jelly Protection is a goodwill programme. It is not insurance, and it is not a contractual guarantee of payment. It is included at no charge, and every payment under it is made at Jelly’s sole discretion.
Protection covers a lender for an Item lost, stolen, or damaged beyond normal wear during a rental booked and paid for through Jelly.
Coverage without supporting documentation:

17. Credits
- Credits are Jelly account credit. They are applied against your next booking. They are not redeemable for cash and are not paid to a bank account.
- Fit refunds, lender-cancellation payments and referral rewards are paid in credits.
- Referrals: $10 in credits once a friend you invited completes their first rental, up to 10 friends.
[LAWYER / OPEN] Credit expiry. Pickle’s credits expire in 2–4 weeks. Jelly applies no expiry today and none has been decided, so no expiry is stated here. New York gift-certificate rules may bear on this.18. Buy
Some listings are offered for sale as well as for rent. Where a listing shows a buy price:
- The purchase is instant — you buy at the listed price, the same way you book a rental.
- The Item is delivered by one courier leg ($10, paid by the buyer) or by free handoff.
- Not as described: the same 12-hour inspection window applies. Report within 12 hours of delivery with photos.
[Q16 OPEN] Jelly’s commission on a sale. Every take-rate figure we hold is scoped to rental price; no sale commission is published anywhere. Not stated here.[Q17 OPEN] Returns on a purchase beyond not-as-described. Pickle’s position is that fit refunds on purchases are at the seller’s discretion, paid in credits, and that there are no change-of-mind returns. Not yet adopted for Jelly, so not stated here.[Q18 OPEN] Cancelling a purchase. The only rule that maps across is the rental one — full refund until the courier is dispatched, none after. A lender can turn on lower offers for a listing. When it is on, a renter can propose a price below the listed one, and the lender accepts or declines it. When it is off, the listed price is the price.

Every Item must be yours to lend or sell, accurately described, and clean.
20.1 Not permitted at all
- Electronics, other than cameras
- Services, digital goods, and gift cards
- Food, drink and supplements
- Animals, and parts of protected or endangered species — including ivory, sea-turtle shell, coral, and protected feathers
- Real estate and vehicles
- Weapons
- Aerosols, flammables, drugs, alcohol, medical devices, and recalled products
20.2 Not permitted as rentals — hygiene
Underwear, hosiery, bras, wigs, and jewellery for pierced ears or other piercings may not be listed for rent.
20.3 Listed only with disclosure
- Real fur and exotic skins must be identified as such in the listing.
- Fine jewellery must state its materials — metal, stone, and whether stones are natural or created.
- Children’s clothing must meet applicable US flammability standards.
20.4 Authenticity — counterfeits
Every Item listed on Jelly must be authentic. Counterfeits, replicas and “dupes” of branded Items are not permitted, whether or not the listing says so.
If we ask you for proof of authenticity, you must provide it. If an Item turns out to be counterfeit:
- the renter or buyer is refunded in full;
- the lender forfeits any earnings on it;
- the listing is removed, and the account moves along the enforcement ladder in section 22 — warning, then restricted listing privileges, then permanent closure. Listing counterfeits at volume closes an account immediately.
21. Your Content
You keep ownership of your Content.
By posting Content to Jelly you grant us a worldwide, royalty-free licence to host, store, reproduce, adapt and display it solely as required to operate, provide and improve the Services — for example, to show your listing photos to renters, to display your reviews, and to back up the app.
[LAWYER] Whether this licence should also be irrevocable, transferable and sub-licensable. Pickle’s terms take all three. That breadth is deliberately not claimed here without sign-off — it reaches beyond running the Services.Content you post publicly can be seen, commented on and reshared by other members within the Services.
You are responsible for your Content. Do not post anything you do not have the right to post.
22. Conduct
Members must follow the Jelly Community Guidelines, which form part of these Terms. In short: treat people with respect, do not harass or dox anyone, do not discriminate, and do not spam.
Where a member breaks these Terms or the Guidelines, we may remove the content, issue a warning, restrict listing privileges, suspend the account, or close it permanently. Serious conduct — abuse of our staff, fraud, or counterfeiting at volume — can close an account on the first offence.

23. Intellectual property
The Jelly name, logo, app, website and design are ours. These Terms do not give you a licence to use them beyond using the Services as intended.
23.1 Copyright complaints
If you believe Content on Jelly infringes your copyright, send a notice to help@onjelly.com including:
- your physical or electronic signature;
- identification of the work you say is infringed;
- identification of the Content and where it is on the Services;
- your contact details;
- a statement that you believe in good faith the use is not authorised; and
- a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for them.
We aim to remove properly noticed Content within 2 business days.
If your Content was removed and you believe that was a mistake, you can send a counter-notice to the same address with the equivalent elements, including your consent to the jurisdiction of the federal court for your district.
We close the accounts of repeat infringers: warning, then restricted listing privileges, then permanent closure.
[LAWYER] Designated copyright agent — name, physical address, phone, and registration with the US Copyright Office. Jelly has no registered agent yet, and DMCA safe harbour requires one.24. Disclaimers
Jelly is not a party to any Transaction between members. We do not manufacture, store, deliver, clean, inspect or authenticate the Items listed on the Services. Listings are written by members and we do not verify them.
The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any Item will meet your expectations.
Jelly Protection (section 16) is a discretionary goodwill programme and is not insurance.
[LAWYER] Consumer-protection carve-outs — some warranty disclaimers are unenforceable against consumers in some states.25. Limitation of liability
To the fullest extent permitted by law:
- Jelly is not liable for indirect, special, exemplary, incidental, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill.
- Jelly’s total liability to you is limited to the greater of $100 or the amount you paid through the Services in the six months before the claim arose.

29. Suspension and termination
- You can stop using the Services at any time. To close your account, write to help@onjelly.com.
- We may suspend, disable or delete an account with or without notice, for any reason or no reason — including where we believe these Terms have been broken.
- A breach ends the licences granted to you under these Terms immediately.
- If your account has been deleted, do not register again.
- Termination does not clear obligations already outstanding: money owed, an Item not returned, or a claim already open.
30. Changes to these Terms
We may change these Terms. Where a change is material, we will give notice in the app or by email before it takes effect. Continuing to use the Services after that means you accept the new Terms.

- If a provision is unenforceable, the rest stays in force.
- Not enforcing a provision is not a waiver of it.
- You may not assign these Terms. We may assign them to a successor.

B. Adaptations made to Pickle’s captured material
Jelly is NYC-only with courier and free handoff, and does not ship (Q7). Pickle’s
prohibited-items list (pickle-legal.md §11) is written for a shipping marketplace,
so it was adapted:
- Dropped “no new-fur sales to California.” A shipping-state restriction. Jelly does not ship and does not sell into California. Replaced with a disclosure requirement.
- Dropped “exotic skins cannot be shipped to California.” Same reason. Replaced with a disclosure requirement.
- Dropped the $10,000 ship ban and the $2,000 courier-insurance ceiling from the item rules. The first is shipping-only; the second is a real courier constraint, but Jelly’s courier contracts do not exist yet — so it appears in §7 as a visible placeholder rather than an asserted limit.
- Kept the hygiene bans on rentals (underwear, hosiery, bras, pierced jewellery, wigs) unchanged — they are about the garment, not the carrier.
- Kept the wildlife bans (ivory, sea-turtle shell, coral, protected feathers, endangered species) unchanged — federal, not carrier-dependent.
